Non-Conviction Secured in Serious Affray Matter

Our client was recently charged with affray following an incident that resulted in the victim sustaining temporary loss of consciousness. The matter was aggravated by the serious nature of the injuries, the presence of alcohol, and the initial perception of aggressive conduct.

From the outset, we worked closely with the client to prepare comprehensive submissions that acknowledged their responsibility while providing full context around the incident, including emotional strain, mitigating environmental factors, and their genuine efforts to prevent escalation on the night in question.

We presented detailed subjective material of the client’s remorse, rehabilitation, and positive character, including evidence of their engagement in mental health treatment, abstention from alcohol, and genuine remorse. The Court accepted that the conduct was out of character and not driven by malice or aggression.

Ultimately, the Court was persuaded to exercise its discretion under Section 10(1)(b) of the Crimes (Sentencing Procedure) Act, imposing a Conditional Release Order without conviction.

This outcome allows our client to continue rebuilding their life and supporting their family, without the lasting burden of a criminal conviction.

It is a powerful reminder that context, accountability, and early rehabilitation can make a meaningful difference in sentencing outcomes.
