Our criminal solicitor, Sam Oakley, recently appeared before Belmont Local Court representing a client facing a serious domestic violence charge. The maximum penalty for this charge in the Local Court is two years imprisonment, a fine of $5,500 or both.
Mr Oakley assisted the client throughout the legal process and it was clear to Mr Oakley from the beginning that the client had been wrongfully charged. A criminal conviction would have resulted in a loss of the client’s employment. Mr Oakley was able to draw the attention of the Police to the deficiencies in their case against the client which resulted in the criminal charge being withdrawn prior to the Hearing date.
Mr Oakley was able to assist the client further by making an application for costs, which is an order by the Court for the Police to pay the legal fees incurred by the client. Mr Oakley was able to use his legal knowledge to successfully argue that Police should pay the legal costs of the client.
